Warranty Terms

Terms of the limited manufacturer’s warranty provided by CADnetwork GmbH for selected new servers and workstations manufactured by CADnetwork.

1. Limited Manufacturer’s Warranty

Depending on the agreement with the customer, CADnetwork grants a limited manufacturer’s warranty for certain new servers and workstations manufactured by CADnetwork with regard to workmanship and materials. The warranty period differs depending on the product. Whether a warranty is included for the product and, where applicable, the duration of the warranty for the respective product are stated in the offer or order confirmation.

The warranty begins on the invoice date. The warranty applies exclusively to the CADnetwork device itself and does not cover external peripherals such as keyboards, mice or other components, or third-party software.

If defects occur during the warranty period, CADnetwork shall, in accordance with the following terms, either provide replacement parts, repair or replace the complete computer system or individual components, or, in special cases, refund the purchase price of an individual component.

2. Provision of Replacement Parts

If the defective component is replaceable, CADnetwork will provide a replacement component required for the repair free of charge for self-replacement by the customer. We will be pleased to support you by telephone during the replacement process.

Depending on the product, the optional extension “On-Site Replacement” may be purchased. Under this extension, defective and replaceable hardware components can be replaced on site at the customer’s premises. No diagnosis and/or error verification is carried out on site. “On site” refers to the original delivery location of the order.

On-site replacement at the customer’s premises can only take place if a hardware defect of a replaceable component has already been clearly diagnosed by CADnetwork customer service (e.g. defective memory module or defective storage drive) and can be remedied by simple replacement.

If it has not been clearly established which component is actually defective, on-site replacement cannot take place. If the component to be replaced cannot be exchanged on site at the customer’s premises due to its complexity (e.g. because special tools, test equipment or a special working environment are required), it is excluded from “On-Site Replacement”.

The date for any on-site replacement will be agreed jointly with the customer and depends on the availability of replacement parts and service technicians.

3. Repair or Replacement

If, in CADnetwork’s assessment, repair of the computer system or a component is required, or if the device must be replaced, the buyer must send the device to CADnetwork.

For this purpose, the product must be packed securely for transport in its original packaging. The customer bears the transport risk for shipment to CADnetwork; CADnetwork bears the transport risk for the return shipment to the customer.

4. Refund of the Purchase Price of a Component

In the special case that no suitable replacement part is available for a component or cannot be provided for other reasons, CADnetwork is entitled to issue a partial refund of the purchase price, specifically the refund of the original purchase price of the individual component.

6. Relationship to Statutory Defect Claims

This warranty does not restrict your statutory defect claims under purchase or work contracts pursuant to Sections 437 et seq. and 634 of the German Civil Code (BGB), which are described in the corresponding sections of our General Terms and Conditions. You may therefore have rights both under this warranty and under statutory warranty law.

7. Exclusions from the Manufacturer’s Warranty

This manufacturer’s warranty does not apply to wear parts or consumables, nor to devices where the serial number has been removed or damaged.

The manufacturer’s warranty also does not apply to devices that have been damaged or are defective as a result of misuse or improper use, contamination, force, lack of care, improper or malicious use, or improper maintenance or calibration.

Also excluded are damages or defects caused by external factors such as accidents, natural and environmental disasters, acts of war of any kind, seizures or other sovereign interventions, faulty installation or electrical supply, overvoltage (e.g. lightning strikes, voltage spikes in the supply network) and fire damage.

Further excluded are damages or defects caused by unauthorized modification, expansion, manipulation or attempted repair of the hardware, including by third parties acting as suppliers, contractors or under a repair order, by operation outside the usage parameters of the included components such as ambient temperature or humidity, by the use of software, interfaces, parts or accessories not supplied by CADnetwork, and by improper preparation or maintenance of the workplace.

The manufacturer’s warranty also does not apply to damages or defects caused by computer viruses or malware, by damage or loss during transport, or by modifications or maintenance not performed by CADnetwork itself or not performed within the scope of the permissible installation of warranty replacement parts provided by CADnetwork by the buyer or the buyer’s authorized representatives.

8. No Further Warranties

CADnetwork provides no further warranties, in particular no warranty regarding the suitability of the product for a particular purpose.

9. Data Backup and Liability for Data

As a precaution, CADnetwork strongly recommends regular backup copies of the data stored on the storage media used. Before sending in a device for repair, you should always create a backup copy of all data and delete all confidential, private or protected information.

CADnetwork assumes no liability for damage to data and programs or for their restoration, with the exception of the operating systems and programs present on the new device at the time of delivery. This exclusion of liability does not apply in cases of intent or gross negligence.

10. Ownership of Replaced Components

Upon removal or replacement of a device or component, we acquire ownership of the removed or replaced devices or components.

11. Geographical Scope

The warranty applies to the Federal Republic of Germany or, if offered in the offer, also in other countries.

14. Validity of These Warranty Terms

These warranty terms apply from 01/01/2024 and remain valid until CADnetwork publishes changes to the warranty terms on the CADnetwork website.
